These terms apply to debate, podcast, live-room, social publishing, AI-assisted media, avatar, AR overlay, recording, storage, replay, transcription, clipping, advertising, and export features.
1. Acceptance of Terms
By accessing or using Answer The Question, including debate rooms, podcast rooms, live streaming, recordings, replays, clips, AI-assisted tools, social sharing, purchases, and account features, you agree to these Terms of Service and any feature-specific notices presented to you. If you do not agree, do not use the platform.
2. Platform Purpose
Answer The Question is a debate, podcast, live-room, media-production, and audience-engagement platform. The service may allow users to create rooms, participate in discussions, upload or record content, use avatars or AR overlays, generate transcripts and clips, and publish or export content to third-party platforms.
3. User Accounts and Authority
Users are responsible for maintaining account security and for all activity under their account. You agree to provide accurate information, use the platform only for lawful purposes, and obtain any authority required to act for a business, school, organization, team, parent, guardian, participant, guest, or connected social-media account.
4. User Content and Platform License
As between you and Answer The Question, you retain the rights you hold in content you create or submit, including audio, video, comments, debate materials, podcast materials, images, prompts, recordings, and uploaded files. You grant Answer The Question a limited, non-exclusive license to host, store, reproduce, process, transcode, stream, display, moderate, create requested technical derivatives from, and distribute that content only as reasonably needed to operate, secure, support, and deliver the service and the publishing or export instructions you authorize.
5. Recording Notice and Consent
Purchasing a package, opening a room, or having access to recording tools does not itself give a Content Creator permission to record another person. Before recording, the Content Creator or authorized host must provide clear notice and obtain every consent required by the laws that apply to the participants and recording location. Because recording laws differ, creators should use affirmative consent from every recorded participant as the platform default. A creator must not secretly record private communications or continue recording a person who has not agreed to the announced recording and use.
6. Content Creator Warranties and Responsibilities
A Content Creator who records, uploads, processes, exports, advertises, or publishes content represents that the creator has all permissions, releases, licenses, and other rights required for the intended use. This includes rights relating to names, images, voices, likenesses, performances, guest contributions, music, photographs, artwork, logos, video footage, confidential material, private communications, and third-party accounts. The creator is responsible for accurately describing whether content will be livestreamed, stored, replayed, transcribed, captioned, clipped, processed with AI, used in advertising, monetized, or posted to external services.
7. Minors, Schools, and Youth Programs
Do not record, upload, profile, advertise with, or publish content involving a minor unless the required parent, guardian, school, district, program, or other authorized-party notices and permissions are in place. Content Creators and organizations are responsible for age-appropriate supervision, access controls, release records, and compliance with applicable child-privacy and student-privacy obligations. Children should not independently submit personal information to the general platform without an authorized and appropriately supervised workflow.
8. AI, Avatars, Voice, Likeness, and Media Tools
AI-assisted tools, avatars, AR overlays, voice alteration, transcription, fact-checking, summaries, and generated media may be imperfect. You may use another person's image, voice, likeness, performance, identity, or reference media only when authorized. You may not create deceptive impersonations, non-consensual intimate content, exploitative content involving minors, or outputs that violate privacy, publicity, copyright, trademark, contractual, biometric, or other rights. Users are responsible for reviewing outputs before approval or publication.
9. Replays, Downloads, Exports, and Third-Party Publishing
A recording, replay, clip, transcript, caption file, or social export may be copied, downloaded, embedded, reposted, indexed, or retained outside Answer The Question after publication or delivery. The Content Creator is responsible for limiting publication to the consent and licenses actually obtained and for responding to participant, rights-owner, or platform requests. Answer The Question cannot guarantee removal of copies controlled by participants, viewers, search engines, social platforms, or other third parties.
10. Social Media and Third-Party Platforms
If you connect or use YouTube, TikTok, Facebook, Instagram, X, or another service, you are responsible for that service's terms, community guidelines, copyright rules, privacy requirements, advertising policies, and account permissions. Answer The Question is not responsible for third-party account restrictions, takedowns, demonetization, retention, data practices, or API changes.
11. Payments and Paid Features
Some features require payment, subscriptions, credits, or package purchases. Prices, included features, storage allowances, retention options, and availability may change. Refunds, cancellations, and disputes are handled according to the purchase terms shown at checkout or in the applicable package description. A required rights or consent certification is a condition of checkout and does not transfer the creator's legal responsibilities to Answer The Question.
12. Prohibited Uses
You may not use the platform to harass, threaten, stalk, exploit, impersonate, defraud, violate privacy or publicity rights, distribute malware, publish illegal material, infringe intellectual property, disclose confidential information without authorization, create or distribute non-consensual intimate imagery, endanger a minor, evade a lawful takedown, or bypass security, moderation, payment, consent, or access controls.
13. Moderation, Takedowns, and Cooperation
Answer The Question may restrict access, stop a livestream, disable a replay, preserve relevant records, remove or limit content, suspend accounts, or cooperate with lawful requests when reasonably necessary to protect users, comply with law, investigate a complaint, enforce these terms, or maintain platform integrity. A disclaimer or creator certification does not prevent review or removal of disputed content.
14. Copyright Complaints and Repeat Infringement
Do not upload or publish content you do not have the right to use. Rights owners may submit a copyright complaint through the Contact Us page with identification of the protected work, the disputed material and its location, contact information, a good-faith statement, an accuracy and authority statement, and an electronic or physical signature. Answer The Question may remove or disable access to material and may terminate repeat infringers under an adopted repeat-infringer policy.
15. Storage, Retention, and Deletion
Recordings and related files may be stored to provide creator workspaces, replays, archives, transcripts, clips, exports, dispute records, and paid deliverables. Retention may depend on the package, event settings, legal requirements, provider capabilities, backup cycles, and an active dispute or safety investigation. Creators should delete material they no longer need and must not use Answer The Question as an indefinite archive unless the applicable package expressly provides that service. Account deletion may not remove transaction records, audit logs, lawful preservation copies, backups awaiting expiration, or files already downloaded or published elsewhere.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Answer The Question and its owners, operators, contractors, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from your content, your recording or publishing decisions, your failure to obtain required consent or rights, your violation of law, or your breach of these terms.
17. Service Availability
The platform relies on third-party services for hosting, authentication, storage, live video, payments, social publishing, AI, rendering, and email. We do not guarantee uninterrupted service and are not responsible for outages, data loss, publication delays, or provider actions outside our reasonable control.
18. Disclaimer of Warranties
The service is provided as is and as available. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. Platform notices, checkboxes, templates, and workflow controls are operational safeguards and are not legal advice.
19. Limitation of Liability
To the maximum extent permitted by law, Answer The Question and its owners, operators, contractors, and service providers will not be liable for indirect, incidental, consequential, special, punitive, or lost-profit damages arising from use of the platform. Some jurisdictions do not allow certain exclusions, so portions of this limitation may not apply to you.
20. Changes and Contact
We may update these Terms of Service as the platform, providers, legal requirements, or business practices change. Continued use after an effective update means you accept the revised terms. For questions, rights complaints, or legal notices, use the Contact Us page or email info@answerthedamnquestion.com.
